ca vehicle code section 23152San Diego Charger Vincent Jackson Pleads Guilty to Second DUI Charge and How an Experienced Southern California Criminal Defense Attorney Can Help You – California Vehicle Code Section 23152It was recently reported that Vincent Jackson, wide receiver for the San Diego Chargers football team, pled guilty to his second driving under the influence (DUI) offense. Jackson was pulled over and cited for DUI in January of this year. Jackson was sentenced to five years probation, four days in jail, a $2,408 fine, 10 days of community service, mandatory attendance in a MADD (Mothers Against Drunk Driving) class, and involvement in the state’s multiple conviction program, which lasts at least 18 months. Driving under the influence (DUI) charges are regulated under California Vehicle Code Section 23152. Driving under the influence is normally charged as a misdemeanor (though DUI can be charged as a felony if someone is injured in the crime). A second DUI conviction in 10 years results in an extremely harsh sentence. Very few misdemeanor convictions carry a mandatory jail sentence. While the minimum jail sentence is four days, some judges impose a harsher jail sentence, including 30, 60, and even 90 day jail sentences. She was arrested by her home in La Jolla after police observed her driving on the wrong side of the road. San Diego 10 News also reported that police had Ross perform a field sobriety test after pulling her over. She was taken to Las Colinas women’s jail in Santee. It is important to understand your rights when you have been pulled over by police for a suspected DUI charge. You will be required to furnish the police with your driver’s license, proof of insurance, and proof of registration. However, know that you are not legally required to participate in field sobriety tests as did Ross in the story above. You can legally refuse to do them. In order for a field sobriety test to be admissible in court, it must be done voluntarily. You should never participate in any of these tests without consulting an experienced San Diego DUI lawyer. Mr. Pasdar was stopped on Interstate-405 in California for going 90 mph at 2:59 a.m. He apparently refused a breathalyzer test, and was taken into custody with the bail set at $15,000. Refusing to take a breathalyzer test or any chemical test whether it be a breath test or giving a blood sample can have consequences that affect your Driver’s License. A chemical test is needed to determine your blood alcohol content, otherwise known as “BAC.” If you refuse to submit to a chemical test, you can be restrained and be forced to be tested. Refusal of a chemical test may result in a one year suspension of your driver’s license without the possibility of a restricted license. California law requires that a person to submit to a chemical test upon request of a peace officer.
